1.1. These Terms of Use (hereinafter referred to as the “Terms”) govern the relationship between the user (hereinafter referred to as the “User”) and the developer of the mobile application “Ember Tracker” (hereinafter referred to as the “Application” or the “Developer”).
1.2. The Application is a mobile software product intended for personal use and for recording intimate events (hereinafter referred to as the “Events”).
1.3. By installing the Application, using it, or continuing to use it after updates to the Terms, the User confirms that they have read, understood, and agreed to these Terms in full.
1.4. If the User does not agree with these Terms, they must discontinue use of the Application and remove it from their device.
2.1. The “Ember Tracker” Application is intended for maintaining personal records of intimate events.
2.2. The Application operates on mobile devices running iOS and Android operating systems.
2.3. The Developer is an individual acting in their own name.
2.4. The Application does not provide medical, psychological, diagnostic, or any other professional advice and does not replace consultation with qualified specialists.
2.5. The Application is intended solely for personal, non-commercial use.
3.1. The Application may only be used by individuals who are at least 18 years of age.
3.2. The Developer shall not be liable for inaccurate information provided by Users regarding their age.
4.1. Use of the Application does not require mandatory registration.
4.2. An anonymous account is automatically created for the User.
4.3. The User may optionally link an email address for the purpose of synchronizing data between devices.
4.4. The User is responsible for maintaining the confidentiality of their account credentials and for all activities carried out under their account.
5.1. The User may independently enter and store information about Events, including date, time, location, description, notes, as well as information about other participants (name, photo, gender, date of birth).
5.2. All content entered by the User is stored exclusively within the User’s personal account and is neither published nor shared with other users.
5.3. The Developer does not moderate user content but reserves the right to remove data that violates the laws of the Russian Federation or contains information contrary to public morals.
5.4. The User bears full responsibility for the legality, accuracy, and appropriateness of the data they enter.
6.1. The User agrees to use the Application in compliance with the applicable laws of the Russian Federation.
6.2. The following actions are prohibited:
6.3. The Developer reserves the right to temporarily or permanently restrict the User’s access to the Application in case of violation of these Terms.
7.1. The Application processes data voluntarily entered by the User for the purpose of using the Application’s functionality, including:
7.2. Data is stored on Supabase infrastructure servers located within the territory of the Russian Federation.
7.3. The Developer takes all reasonable measures to protect User data from unauthorized access, loss, or alteration.

7.5. The Application may request permission to access certain device system features (such as gallery access and notifications) solely to provide the declared functionality.
7.6. At the time of publication, the Application does not use third-party analytics or advertising services. In the future, certain versions of the Application may include in-app advertising. In such case, the relevant information will be reflected in these Terms and in the Privacy Policy.
8.1. The User has the right to delete all their data through the Application interface (“Menu” → “Account” → “Delete all application data”).
8.2. Once deleted, data cannot be restored.

9.1. The functionality of the Application may vary depending on the platform (iOS / Android) and distribution store (App Store, Google Play, Rustore, Huawei App Gallery, Samsung Galaxy Store).
9.2. At the time of publication:
9.3. Up-to-date information about available features is displayed in the respective version of the Application.
10.1. Paid features may be available only in certain versions of the Application depending on the platform and distribution store.
10.2. In Android versions distributed via Rustore, Huawei App Gallery, and Samsung Galaxy Store, Users may be granted temporary paid access to extended functionality.
10.3. Payments in Rustore, Huawei App Gallery, and Samsung Galaxy Store versions are processed via the third-party payment service YooKassa. The Developer does not process or store Users’ payment data.
10.4. In the iOS (App Store) and Google Play versions, no paid features are available at the time of publication.
10.5. Refund terms apply only to versions where paid functionality is provided.
11.1. The Application is provided on an “as is” basis.
11.2. The Developer shall not be liable for any damages arising from the use or inability to use the Application, including but not limited to data loss, breach of confidentiality, or technical failures.
11.3. The Developer does not guarantee uninterrupted or error-free operation of the Application.
11.4. The Application is not intended for medical, psychological, diagnostic, or other professional purposes.
12.1. The Developer reserves the right to amend these Terms at any time.
12.2. The updated version of the Terms shall enter into force upon its publication within the Application or on the official website.
12.3. Continued use of the Application constitutes acceptance of the updated Terms.
13.1. These Terms shall be governed by the applicable laws of the Russian Federation, unless otherwise required by mandatory provisions of the law of the User’s country of residence.
13.2. All disputes shall be subject to resolution in the courts at the Developer’s place of residence.
13.3. If any provision of these Terms is found invalid, the remaining provisions shall remain in full force and effect.
14.1. All rights to the Ember Tracker Application, including its design, source code, databases, and related materials, belong to the Developer. The User is not granted any rights to reproduce, modify, reverse engineer, distribute, or commercially exploit the Application without the Developer’s prior written consent.
